1. About Islampur.in

Welcome to Islampur.in (“Islampur.in”, “we”, “us” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, and the products and services offered through them.

Business owner: Iqbal Arzoo
Business structure: Individual / Sole Proprietorship
Business address: Melamath, Islampur, West Bengal, India – 733202
Email: Arzoo@islampur.in
Phone / WhatsApp: +91 7066066669
Website: https://islampur.in

By visiting our website, placing an order, or using our services, you agree to these Terms and the policies incorporated by reference. If you do not agree, please discontinue use of the relevant services.

These Terms are intended to apply to a multi-category online store. Products and services may be added, changed or discontinued over time.

2. Eligibility and use of the website

You must be at least 18 years old and legally capable of entering into a binding contract to make purchases in your own name. If a purchase is made on behalf of a minor, it must be handled by a parent or legal guardian where permitted by law.

You agree to provide accurate, current and complete information when creating an account, placing an order, making a payment or contacting us.

You must not:

• Use the website for unlawful, fraudulent or misleading purposes.
• Provide false delivery, billing, identity or payment information.
• Attempt to interfere with the website, its security, functionality or other users.
• Introduce malicious code or attempt unauthorised access to systems or accounts.
• Abuse promotions, payment facilities, customer support or return processes.
• Infringe our intellectual property or the rights of other people.

We may restrict access or take proportionate action where there is a reasonable basis to believe these Terms have been breached. Any action will remain subject to applicable law and mandatory consumer rights.

3. Products, categories and product information

Islampur.in may offer products across multiple categories, including fashion, electronics, home and kitchen, beauty, health and wellness, jewellery, groceries, toys, baby products, digital products and other lawful categories.

Product descriptions, images, specifications, colours, dimensions, compatibility information, availability and prices are provided to help customers make informed purchasing decisions.

We take reasonable care to present product information accurately. However, minor differences in colour, appearance or packaging may occur because of screen settings, manufacturing updates or supplier changes. Such differences do not remove any rights you may have where a product is materially misdescribed, defective or not as agreed.

Please review the product listing, specifications, safety information, compatibility requirements and any category-specific terms before ordering. Do not rely on general product descriptions as a substitute for professional advice where a product requires it.

Nothing in this section excludes remedies available under applicable law for defective, unsafe, counterfeit, materially misdescribed or otherwise non-compliant products.

4. Prices, taxes and pricing errors

Prices will be displayed in the currency indicated on the website. Applicable taxes, delivery charges and other mandatory charges will be disclosed as required before you complete your purchase.

We aim to ensure that prices and product information are accurate. If a listing contains a suspected pricing, description or calculation error, we may review the circumstances and contact you before fulfilling the order.

Depending on the circumstances and applicable law, we may offer to fulfil the order at a corrected price with your agreement or cancel the affected order and refund amounts paid for it. We will not treat an internal pricing error as permission to disregard mandatory consumer protections or other legal obligations.

Promotional prices, discounts, coupons and offers are subject to their stated eligibility criteria, validity periods, stock availability and terms. We may modify or end an offer prospectively, subject to applicable law and any obligations arising from an already confirmed transaction.

5. Orders and order acceptance

Submitting an order is an offer to purchase the selected products or services on the applicable terms.

An order confirmation or automated message may acknowledge receipt of your order; it does not necessarily mean that the order has been finally accepted or dispatched. Order acceptance and fulfilment may depend on payment confirmation, stock availability, verification, delivery serviceability and other legitimate fulfilment requirements.

We may contact you to clarify information or verify an order where reasonably necessary. If an order cannot be fulfilled, we will notify you and arrange any refund due under applicable law and our published policies.

We will not cancel or refuse an order on an unlawful or discriminatory basis.

6. Product availability and substitutions

Product availability can change. If an ordered product becomes unavailable, we may contact you to offer a suitable substitute.

A substitute will only be supplied if you agree to it. If you decline a substitute, or no suitable substitute is agreed upon, we will cancel the unavailable item and refund the amount paid for that item as applicable.

We will not substitute a materially different product without your consent.

7. Payments

We may offer payment methods displayed at checkout, subject to availability and eligibility. These may include prepaid payments through supported payment providers and cash on delivery (“COD”) where available.

Payment processing may be performed by third-party payment gateways, banks or other authorised providers. Their own terms, verification procedures and security processes may apply.

You must use a payment method that you are authorised to use. We do not intentionally collect or store complete payment-card credentials outside the systems and processes used by our payment providers.

An order may be delayed or held where payment remains pending, is declined, is reversed, or requires legitimate verification. Any action taken will be subject to applicable law.

Cash on delivery

COD availability may depend on the delivery location, order value, product category, serviceability and other disclosed eligibility criteria.

We may review repeated refused deliveries or suspected misuse and may restrict COD availability where justified. We will consider relevant circumstances, including delivery errors, damaged parcels and events outside your reasonable control. Any restriction will comply with applicable law and will not remove statutory consumer rights.

8. Shipping, delivery and risk

Delivery dates and timeframes shown on the website or communicated by our delivery partners are estimates unless expressly identified as guaranteed in writing.

Delivery may be affected by factors including courier capacity, weather, public holidays, transport disruption, address errors, security restrictions or other circumstances outside our reasonable control. We will take reasonable steps to communicate material delays when appropriate.

Please provide a complete and accurate delivery address and contact number. If delivery fails because information provided by you is incorrect or the recipient is unavailable, we may coordinate another delivery attempt or other lawful arrangements.

We will not use this section to avoid obligations relating to non-delivery, defective goods or other matters for which we remain responsible under applicable law.

9. Cancellations

Order cancellation requests are handled in accordance with our published Return & Refund Policy and applicable law.

Our general operational approach is:

• Before packing: Eligible cancellation requests will receive a full refund for prepaid orders, without a cancellation deduction.
• After packing but before dispatch: We will review the request. Any deduction, if legally permitted, must reflect actual, documented and appropriately disclosed costs; arbitrary penalties will not be imposed.
• After dispatch: Ordinary cancellation may no longer be available. Where applicable, you may use the return process after delivery or pursue remedies available under law.

These operational rules do not limit any cancellation, refund or other remedy that is mandatory under applicable law.

10. Returns, refunds and exchanges

Our separate Return & Refund Policy explains the applicable request process, eligibility conditions, return shipping, inspections, cancellations, refunds and any category-specific restrictions.

That policy forms part of these Terms and should be read before ordering.

Our current general policy includes a 15-minute return-request window, subject to the specific terms published in the Return & Refund Policy. Approved claims involving damaged, defective, incorrect or incomplete orders will be handled under that policy and applicable law.

For ordinary eligible change-of-mind returns, return shipping and delivery-charge treatment will follow the published policy. Prepaid refunds are generally made to the original payment method. COD refunds are handled using the method described in the Return & Refund Policy, subject to practical requirements and applicable law.

Return requests may require authorisation and inspection. We may request reasonable supporting information to assess a claim. Any decision will be made in accordance with the published policy and applicable law.

No time limit, exclusion, evidence requirement or other term in our policies is intended to remove a consumer remedy that cannot lawfully be excluded. Where the law provides a remedy for a defective, deficient, unsafe, counterfeit, materially misdescribed or undelivered product, the applicable legal rights prevail.

11. Digital products and third-party services

Islampur.in may offer digital products or facilitate services such as mobile recharges, bill payments or other digital transactions through third-party providers, where these services are made available.

The availability, processing time, service coverage, eligibility and transaction requirements may depend on the relevant provider. Provider-specific terms may apply and will be disclosed or linked where appropriate.

A transaction may be considered successfully processed when the relevant provider confirms successful delivery, activation, recharge or payment. For failed, delayed, duplicate or incorrectly processed transactions, contact us with the transaction reference and supporting information so the issue can be reviewed.

Digital products and successfully processed recharges or bill payments may not be eligible for change-of-mind refunds once delivered, activated or completed, where permitted by applicable law and the relevant provider’s terms. This does not exclude remedies for failed or duplicate transactions, errors attributable to us or a provider, or any refund or other remedy required by law.

We do not guarantee uninterrupted availability of third-party services and cannot promise that every provider will support every transaction at all times. We will take reasonable steps to assist with reported issues within our responsibility.

12. Third-party sellers and marketplace features

At the time these Terms are published, Islampur.in intends to sell its own products and may introduce third-party sellers in the future. Marketplace functionality is not represented as active unless expressly made available on the website.

If third-party sellers are introduced, we will provide relevant seller, product, fulfilment and contact information as required by applicable law. Additional marketplace terms may apply and will be presented before or at the time they become relevant.

The responsibility for a product, its fulfilment, warranty, return, refund or other issue will depend on the transaction structure, the information shown to you and applicable law. We will not use the involvement of a seller, supplier, payment provider or delivery partner to exclude any responsibility that the law places on Islampur.in.

Any additional marketplace terms will be incorporated into these Terms only where properly published and applicable to the relevant transaction.

13. Customer accounts and communications

You may be able to place orders as a guest or create an optional customer account.

You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account, subject to applicable law. Notify us promptly if you suspect unauthorised access.

We may send transactional communications about order confirmation, payment, dispatch, delivery, cancellations, returns, refunds, security or customer support.

Promotional emails, SMS or WhatsApp messages will be sent only where appropriate consent or another lawful basis exists. You may opt out of promotional communications using the available unsubscribe or opt-out method. Opting out of marketing will not necessarily stop essential messages relating to an order or service.

Our Privacy Policy explains how personal information is handled.

14. Reviews, comments and customer content

If our website permits product reviews, ratings, comments or other customer submissions, you agree that your content must be lawful, relevant and based on your genuine experience where presented as a review.

You must not submit content that:

• Is false, fraudulent, fabricated or deliberately misleading.
• Is abusive, threatening, defamatory, discriminatory or unlawful.
• Infringes another person’s copyright, trademark, privacy or other rights.
• Contains spam, malware, unauthorised advertising or confidential personal information.
• Manipulates ratings or reviews or impersonates another person.

We intend to permit only verified-purchase reviews where the relevant review feature supports verification. We may moderate, decline, remove or restrict customer content in accordance with our published moderation standards and applicable law. We will not claim that a review is verified unless it has been verified through an appropriate process.

You retain ownership of content you lawfully submit. By submitting content, you grant us a non-exclusive, royalty-free permission to host, display, reproduce and use it as reasonably necessary to operate, moderate and promote the relevant website, product or service, subject to applicable law and your rights. You confirm that you have the rights needed to grant this permission.

Contact us if you believe content infringes your rights or is unlawful.

15. Intellectual property

Unless otherwise indicated, the Islampur.in name, branding, website design, original text, graphics and other original materials owned by us are protected by applicable intellectual-property laws.

You may browse the website and use it for personal, lawful shopping purposes. You may not copy, reproduce, distribute, commercially exploit, modify or create derivative works from our protected materials without prior permission, except where permitted by law.

Product names, logos, images and other materials belonging to third parties remain the property of their respective owners and may be used under licence or other lawful permission. Their appearance on our website does not necessarily imply sponsorship or affiliation.

If you believe material on the website infringes your intellectual-property rights, please contact us with details of the material and the basis of your claim.

16. Promotions, coupons and offers

Promotions, discounts, coupons, loyalty benefits and special offers may have individual conditions, expiry dates, exclusions, stock limits or eligibility criteria.

Unless an offer expressly provides otherwise, offers cannot be combined, transferred or exchanged for cash. We may correct errors, suspend suspected misuse or change future promotional availability where justified and lawful.

Changes will not be used to disregard rights arising from an already confirmed order or to mislead customers about the terms of an offer.

17. Third-party websites and services

Our website may contain links to, or integrations with, third-party websites, payment providers, delivery services, analytics tools or other services.

Third-party services are generally governed by their own terms and privacy policies. We do not control every aspect of their operation and cannot guarantee their uninterrupted availability, security or accuracy.

This does not exclude any responsibility that applicable law places on us for our own conduct, representations, contractual obligations or use of third-party providers.

18. Disclaimer and limitation of liability

To the extent permitted by applicable law, Islampur.in will not be liable for indirect or consequential losses that were not reasonably foreseeable, or losses arising from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law. In particular, these Terms do not waive mandatory consumer rights or exclude remedies for fraud, wilful misconduct, statutory liability, or other matters that cannot lawfully be excluded.

We do not guarantee that the website will always be available, uninterrupted or error-free. We will take reasonable steps to maintain its operation and address material issues.

Nothing in this section limits any remedy available to you under applicable consumer-protection law.

19. Indemnity

To the extent permitted by law, you may be responsible for direct losses, claims or reasonable costs arising from your unlawful use of the website, deliberate misuse of our services, infringement of third-party rights or material breach of these Terms.

This clause does not require you to indemnify us for our own unlawful conduct, negligence where liability cannot be excluded, or obligations that cannot legally be transferred to you.

20. Suspension and termination

We may suspend or restrict website access, account features or particular services where reasonably necessary to address security risks, suspected fraud, unlawful activity, technical issues or a material breach of these Terms.

Where appropriate and lawful, we will provide an explanation or an opportunity to resolve the issue. Suspension or termination will not remove accrued rights, pending refund obligations or mandatory legal remedies.

You may stop using the website at any time. Closing an account, where that feature is available, does not automatically cancel an order or remove obligations relating to an existing transaction.

21. Privacy and personal information

Our Privacy Policy explains the categories of personal information we may collect, how we use and share it, how cookies and analytics may operate, and how you can contact us about privacy matters.

By using the website, you acknowledge that you have been given access to the Privacy Policy. Personal information will be handled in accordance with that policy and applicable law.

22. Events outside reasonable control

We will not be responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, severe weather, transport disruption, strikes, government action, widespread network failures or interruption of essential third-party services.

This clause applies only to the extent permitted by law. It does not remove obligations to communicate appropriately, refund payments where required, or provide remedies mandated by applicable law.

23. Changes to these Terms

We may update these Terms to reflect changes in our operations, products, services, legal requirements or website features.

The updated version will be published on this page with a revised “Last updated” date. Changes generally apply prospectively from the stated effective date, subject to applicable law and existing contractual rights. Where a change materially affects an existing transaction, we will handle it in accordance with applicable law.

You should review this page periodically.

24. Governing law and disputes

These Terms are governed by the laws of India.

Any dispute will be subject to the jurisdiction of the competent courts and consumer dispute-resolution bodies in India, as determined by applicable law. Nothing in these Terms prevents you from approaching a consumer commission or other authority that has jurisdiction under mandatory law.

We encourage you to contact us first so that we can attempt to resolve a concern promptly. However, contacting us is not a condition for exercising a statutory right or filing a complaint where the law permits you to do so.

25. Grievance redressal and customer support

For questions, complaints, order issues, return or refund requests, privacy concerns, or other service matters, you may contact us through the available support channels.

We will acknowledge and address grievances within the timeframes required by applicable law. Where a specific statutory timeframe applies, that timeframe takes priority over any general statement on this page.

26. Severability and no waiver

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.

A failure or delay in enforcing a provision does not automatically waive our right to enforce it later.

27. Entire agreement and policy hierarchy

These Terms, together with the policies and transaction-specific conditions presented to you, govern your use of Islampur.in and the relevant purchase or service.

If there is a conflict between these Terms and a mandatory legal requirement, the law prevails. If a product-specific or service-specific term conflicts with a general provision, the specific term will apply to the extent lawful and properly disclosed.

Nothing in these Terms is intended to exclude a right or remedy that cannot lawfully be excluded.
